The problem of justifying legal punishment has been at the heart of legal and social philosophy from the very earliest recorded philosophical texts. However, despite several hundred years of debate, philosophers have not reached agreement about how legal punishment can be morally justified. That is the central issue addressed by the contributors to this volume. All of the essays collected here have been published in the highly respected journal Philosophy & Public Affairs. Taken together, they offer not only significant proposals (...) for improving established theories of punishment and compelling arguments against long-held positions, but also ori-ginal and important answers to the question, "How is punishment to be justified?"Part I of this collection, "Justifications of Punishment," examines how any practice of punishment can be morally justified. Contributors include Jeffrie G. Murphy, Alan H. Goldman, Warren Quinn, C. S. Nino, and Jean Hampton. The papers in Part II, "Problems of Punishment," address more specific issues arising in established theories. The authors are Martha C. Nussbaum, Michael Davis, and A. John Simmons. In the final section, "Capital Punishment," contributors discuss the justifiability of capital punishment, one of the most debated philosophical topics of this century. Essayists include David A. Ethical attitudes and behaviour are complex. This complexity extends to the influencers operating at different levels both outside and within the organisation, and in different combinations for different individuals. There is hence a growing need to understand the proximal and distal influencers of ethical attitudes, and how these operate in concert at the individual, organisational, and societal levels. Few studies have attempted to combine these main research streams and systematically examine their combined impact. The minority of studies that have taken (...) a combined approach have often done so using conventional statistical and analytical techniques which imply linearity between variables—a situation that rarely exists in business settings and is likely to lead to simplistic or even erroneous conclusions. Applying a fuzzy-set qualitative comparative analysis approach, this paper reports on the mutual and simultaneous influence of individual demographic factors, as well as proximal and distal factors stemming from within and outside the work environment to understand individuals’ ethical views within the workplace. The multiple configurations that emerged reveal the complex nature of influencers of ethical attitudes, and reinforce the view that “one size does not fit all”. We discuss these implications together with managerial recommendations and future research directions. (shrink)

The clinical introduction of medical devices often occurs with relatively little oversight, regulation and (long-term) follow-up. Some recent controversies underscore the weaknesses of the current regime, such as the complications surrounding the metal-on-metal hip implants and the scandal surrounding the global breast implant scare of silicone implants made by France's Poly Implant Prothese (PIP) Company. The absence of national registries hampered the collection of reliable information on the risks and harms of the PIP breast implants. To warrant long-term safety, a (...) case can be made for mandatory post-marketing surveillance by means of the establishment of compulsory registries. In this edition of Public Health Ethics, Schofield calls for debate on how such a registry system should be initiated and maintained and how it would relate to the ethical requirement of consent. Here we use breast implant registries as a case to discuss whether and when a so-called ‘thick opt-out’ would be an appropriate method to include people in medical device registries. We conclude that a thick opt-out procedure for medical device registries is only justifiable in cases where inclusion does not involve burdens (or very low), when it does not involve a sensitive subject and when the data are stored anonymously (or at least not directly linked to the medical record). Otherwise, inclusion should be sought by means of an opt-in. (shrink)

L.N. Tolstoy produced an original religious-moral doctrine that became known as Tolstoyism. It was left on the periphery of the spiritual processes in the twentieth century and, undeservedly, was forgotten. This becomes particularly obvious in the context of contemporary discussions about the dialogue of cultures and the interrelation between universalism and particularism. Tolstoy sought only the transcultural foundations of human existence. The basic questions that he examines as a thinker and wrestles with as a human being is the following: what (...) can religion and morality mean to contemporary men for whom reason is the basis of knowledge and individual responsibility is the basis of behavior? The neutrosophic sets were known since 1999, and because of their wide applications and their great flexibility to solve the problems, we used these the concepts to define a new types of neutrosophic crisp closed sets and limit points in neutrosophic crisp topological space, namly [neutrosophic crisp Gem sets and neutrosophic crisp Turig points] respactvely, we stady their properties in details and join it with topological concepts. Finally we used [neutrosophic crisp Gem sets and neutrosophic crisp Turig points] to introduce (...) of topological concepts as: neutrosophic crisp closed (open) sets, neutrosophic crisp closure, neutrosophic crisp interior, neutrosophic crisp extrior and neutrosophic crisp boundary which are fundamental for further reserch on neutrosophic crisp topology and will setrengthen the foundations of theory of neutrosophic topological spaces. The crisis of the theory of socioeconomic formations has recently become clearly apparent in our social philosophy. Earlier as well, the "formational" approach, with its presumption that the new order has "decisive advantages," caused perceptible epistemological difficulties associated with the effect of "inverted perspective." It followed from the theory that socialist Mongolia, Vietnam, and Cuba were a "whole epoch" ahead of the USA and other developed countries of the West that had preserved the outmoded capitalist order.

At present, large teams are at work in virtually all branches of Soviet historical scholarship writing major works of synthesis that present the results of long years of research into the history of literature, economic and political thought, ethics, esthetics, philosophy, and sociology. These works deal with currents that have played any significant role whatever in the history of Russian thought. The greatest attention is given to the Decembrists, the Revolutionary Democrats, the Narodniks, and the Russian Marxists. These trends in (...) the intellectual and socio-political movements have been studied in greater or lesser detail, with the exception perhaps of the Narodnik movement, to which, however, the attention of many historians is now being directed. Context: In the literature of radical constructivism, the epistemology and ontology of religion has been rarely discussed. Problem: I investigate the impact of radical constructivism on some aspects of religion - in particular, on the conflict that is sometimes perceived to arise between religion and natural science, discussed in the context of religious belief. Method: It is argued that the epistemology of radical constructivism serves to distinguish between items of cognitive and non-cognitive knowledge. This makes it possible to discuss issues (...) of religious belief, which are non-cognitive, from a constructivist epistemic and ontological perspective. Results: I conclude that radical constructivism cannot be invoked to support or contradict any particular religious faith; the individual knower will construct her own ontology, as part of her store of non-cognitive knowledge, in interaction with her environment ; on the other hand, any knowledge of it must be constructed in the mind of the knower, and there is no way to identify any one construction as being objectively “right” or “true.” Hence the truth value of propositions of religious conviction cannot be argued in cognitive terms. Implications: It is argued that these results elevate the knower into a position of personal autonomy with respect to religious issues. One consequence of this is the emergence of a fundamental epistemic incompatibility between the worldviews of radical constructivism and religion of any kind. Another is that the old dichotomy between atheism and agnosticism disappears - or rather, becomes irrelevant. Constructivist content: The role played by radical constructivism in the approach to cognitive vs. non-cognitive knowledge is discussed, specifically as pertaining to issues of religion. The construction of knowledge is a strictly personal enterprise, and the use of constructed non-cognitive knowledge then forms a basis for the individual knower’s religious position. (shrink)

This note gives a new proof of the 'operational extensionality' property of Abramsky's lazy lambda calculus-namely the coincidence of contextual equivalence with a co-inductively defined notion of 'applicative bisimilarity'. This purely syntactic results is here proved using a logical relation between the syntax and its denotational semantics. The proof exploits a mixed inductive/coinductive characterisation of the logical relation recently discovered by the author.

The level of medical care to patients and the success of the implementation of the national project "Health" depend on the health status and doctor's professionalism. Modern healthcare reform is being implemented by optimizing costs, merging medical organizations, closing ineffective hospitals, expanding the use of high-tech care and informatization of the doctor's activities. All this makes it necessary to assess the health of doctors. Scientists have studied the quality of life and identified the professional burnout of doctors in children's clinics (...) in different age groups. Primary care pediatricians have a higher quality of life score when compared to the standard [1]. However, all groups have a high level of professional burnout. The pre-retirement group of doctors has more unfavorable profile. They are highly professional specialists but may experience emotional discomfort because the pension system has been reformed. This situation requires the introduction of preventive work with doctors of this age as a group with great potential and capable of professional longevity. (shrink)

Upshot: The experimental conference format described by Durrant et al. is intended to create an open platform for dissemination and knowledge creation. The field of open design, in which designers create structures to support creative action by others, offers relevant insights and alternative approaches. Of all the arguments for the existence of God, the argument from design is in many respects the most impressive, as everyone remarks that Kant remarked. Certainly it is an argument which seems to have appealed to the popular imagination and even today does not lack philosophical proponents. The purpose of the present paper is to examine a recent formulation of the argument.
